Even if the Chamera was not on or dysfunctional that would imply willing negligence on behalf of the jailers placing two offenders in a public holding cell together with out proper observation equipment.

@Kmmlc I think in the situation mike is in, it’s just not worth the time even if it’s possible. The goal was clear to him to make it known he is not to be fucked with, and mike ain’t gonna waste his time suing him when he has bigger fish to fry unless they press him too far

Lawyers and prosecutors are considered officers of the court, so generally when they make a claim that they saw something or had something happen to them first hand, it is given more weight than someone else. But let's say they didn't know that Harvey got the video footage. It goes to trial and Harvey would simply need to ask the Marshal and the jailers about the incident. If they deny it, he can request a recess for the judge to review the footage as it would pertain to perjury and misconduct. More than likely however the judge would be pissed that it got that far into a trial before revealing the video and while he would dismiss with prejudice, he would let Harvey know that it should have been shown to him pre-trial.

This actually happened to me in a Jail in West Virginia it wasn't a federal marshall though it was 2 informants that couldn't go to the other parts of the jail because they were known rats. I had fireworks they charged me with worse. Eric Aheart and Nottingham I'll never forget them. Long story short they dropped the charge. Good thing to because I was looking at 10 years in prison. Life's all about perspective. And mine won me my freedom
a real lawyer never would've admitted he knew, until it cane to informing his own attorney that he recognized his cellmate as that marshal. Then the whole place would be going down with charges of coercion, assault, abuse, etc
That should be enough for them to turn him lose, because that was unlawful assault by a law enforcement officer while detained. It's literally, they let him go or they lose their badges and potentially the badge of their immediate supervisor. This is a trick that probably works 99 percent of the time, but if it fails because someone figures out it's a cop beating them up. Well that goes bad for everyone who signed off on it.
If somebody goes for your throat, you go for their eyes. You may wheeze like an asthmatic, but once their eyes start to leak down their cheeks like raw eggs they will know they are never coming back from that fight the same as when they went in.
