On 24-march-23 judgment has been passed by the Apex court In respect of surrender of those convicts /undertrial prisoners were released on emergency parole and interim bail pursuant to recommendation of High Power committee, in compliance with the orders dated 23-3-20, 7-5-21 and 16-7-21 passed by the Apex court in Suo Motto Write Petition 01/2020 due to Covid 19 pandemic situation In this regards I want to kindly apprise you that in first phase 2020 a total of 4684 (1184 convicts and 3499 undertrials) prisoners were released further during the second wave as per order dated 7-5-21 High Power committee granted payrol of 90 days all inmates who had been released pursuant to the order dated 23-3-20 as per meeting of Constituted High Power committee for Delhi dated 11-05-21 where in High Power committee observed that inmates who were released last year could be released 4th with in view of ranging pandemic. in persuant to which a total of 3630 undertrial prisoners and 751 convicts were released on interim bail or Emergency parole till date. As per order dated 16 -7-21 passed by the Apex court it is clearly directed that the prisoners who were already been released from prison in accordance with the above mentioned order should not be asked to surrender before the prison till authority further order. That presently 680 convicts are still on emergency parole and 71 convicts have surrender voluntary till date and 3365 undertrial are still on interim bail 267 undertrial prisoners have surrender in prison with order of court. That the capacity of Delhi prisons is 10,026 and presently the Delhi prison are in overcrowded situation. The main motive of releasing of prisoners were decongestion the prison to avoid the spreading of Corona virus . The lodgement of prisoners are approximately double the capacity of Delhi Prisons due to which the prisoners who are already lodged in prisons are sufferer of space, food, medicines and basic necessary things. In the present scenerio we are observing the increment in the number of cases of covid and as per the order of Apex court all the prisoners who were released as per the guidelines of HPC are directed to surrender within 15 days before the jail authorities. As the covid cases are increasing day by day there is high apprehension of the 5th wave of Covid. You are most humbly requested to kindly look in to this matter for the sake of those prisoners who were released as per the guidelines of HPC as the prisons are already in overcrowded situation and high apprehension of 5th wave may also prove fattal for lodged prisoners. Earlier we have seen those prisoners who were released once due to Covid pandemic were again lodged in prisons when it seems that covid has been finished in 2020 during the first wave, after one month unexpectedly second wave of corona comes and all those prisoners who were earlier lodged back during first wave were again released on second wave. During the period of third wave the prisoners were not lodged in prisons again as the prisons were overcrowded and there were higher chances of spread of Corona virus. This time also prisons are overcrowded and Corona cases are also increasing, relodgment of prisoners at this stage may prove risky.
